Welcome to HabsInfinity. This page contains our Privacy Policy and Terms of Use. By accessing or using the HabsInfinity website, related pages, features, forms, newsletters, contests, or other services we make available (collectively, the “Services”), you agree to the terms below.
Part I — Privacy Policy
1.WHO WE ARE
HabsInfinity is an independent Montreal Canadiens fan media platform operated by HABSINFINITY (“HabsInfinity,” “we,” “us,” or “our”). We are not affiliated with, endorsed by, or sponsored by the National Hockey League, the Montreal Canadiens, or their respective affiliates.
2.SCOPE OF THIS POLICY
This Privacy Policy explains how we collect, use, disclose, retain, and protect personal information when you use the Services. It is intended to address applicable Canadian privacy requirements, including the Personal Information Protection and Electronic Documents Act (“PIPEDA”) where applicable and Quebec’s Act respecting the protection of personal information in the private sector, as amended, where applicable.
3.INFORMATION WE MAY COLLECT
Depending on how you use the Services, we may collect the following categories of information:
- Information you provide directly, such as your name, email address, social media handle, message content, contest entry information, HabsInfinity-generated session or entry identifiers, verification information, survey or poll responses, and any other information you choose to submit.
- Newsletter and communication information, including subscription status, consent records, and communication preferences.
- Technical and usage information, such as IP address, browser type, device type, operating system, referring pages, pages viewed, approximate location derived from IP address, timestamps, and similar log information.
- Cookie and analytics information collected through cookies, pixels, local storage, or similar technologies, where permitted by law and according to your choices.
- Content you submit or make available to us, including comments, photos, videos, messages, contest submissions, or other user-generated content.
- Information received from third parties when you interact with HabsInfinity through social media platforms, service providers, or other third-party services, subject to their privacy settings and policies.
We do not intentionally request highly sensitive information such as health, financial-account, government identification, or biometric information through the ordinary use of the Services. Please do not send us sensitive personal information unless we specifically request it for a legitimate purpose.
4.HOW WE USE PERSONAL INFORMATION
We may use personal information to:
- Operate, maintain, secure, and improve the Services;
- Respond to questions, messages, requests, and support inquiries;
- Administer, validate, and verify contests, promotions, polls, surveys, and community features, including detecting duplicate, fraudulent, manipulated, or otherwise ineligible entries;
- Send newsletters, updates, or promotional communications where we have the required consent or another lawful basis to do so;
- Understand audience engagement, site performance, and content preferences;
- Prevent fraud, abuse, security incidents, and violations of these Terms;
- Comply with legal obligations, enforce our rights, and protect HabsInfinity, our users, and others; and
- Use information for another purpose that we identify at or before collection, or as otherwise permitted or required by law.
5.CONSENT AND YOUR CHOICES
Where consent is required, we seek consent appropriate to the nature and sensitivity of the information and the purpose for which it is collected, used, or disclosed. You may withdraw consent at any time, subject to legal or contractual restrictions and reasonable notice. Withdrawal may affect our ability to provide certain features or services.
If you receive commercial electronic messages from us, you may unsubscribe using the unsubscribe mechanism provided in the message or by contacting us. We will process unsubscribe requests in accordance with applicable law.
6.COOKIES, ANALYTICS, AND SIMILAR TECHNOLOGIES
We may use cookies and similar technologies to make the website function, remember preferences, understand traffic and performance, measure engagement, and support content or marketing activities. Some technologies may be provided by third-party analytics, hosting, advertising, or social-media providers.
Where required by law, optional identification, localization, profiling, advertising, or similar technologies will not be activated without the required notice and choice. You can also manage cookies through your browser or any cookie-preference controls we make available. Disabling certain technologies may affect site functionality.
Specifically, we use Google Analytics 4, a web analytics service provided by Google LLC. It sets cookies and similar identifiers in your browser and reports to us, in aggregate, how the site is used. The information it collects about your visit includes:
- Pages viewed, time spent on them, and the order you moved between them;
- Approximate geographic location, derived from your IP address rather than precise location data;
- Device, browser, operating system, and screen size;
- How you arrived at the site, such as a link from Instagram or a search engine; and
- Interactions with features such as starting a game, voting in a poll, or saving a lineup image.
We use this to understand which parts of the site people actually use and where they run into trouble. We do not use Google Analytics to identify you personally, and we do not combine it with your leaderboard name, claim code, or any other information you give us. Google processes this information on servers outside Canada, including in the United States, and it may be subject to the laws of those jurisdictions; see the section on service providers and information outside your province, above. You can prevent Google Analytics from collecting your visit by installing Google's opt-out browser add-on at tools.google.com/dlpage/gaoptout, by blocking cookies or scripts in your browser, or by using a browser setting or extension that blocks analytics. Doing so does not affect your ability to use the site.
7.WHEN WE SHARE PERSONAL INFORMATION
We may disclose personal information only as reasonably necessary for the purposes described in this Policy, including:
- To service providers that help us host, operate, analyze, secure, communicate, or administer the Services, subject to appropriate contractual or legal protections;
- To professional advisers where reasonably necessary, including legal, accounting, security, or other advisers;
- In connection with a proposed or completed business transaction, reorganization, financing, sale, or transfer, subject to applicable legal requirements;
- Where required or authorized by law, court order, legal process, or governmental authority;
- Where reasonably necessary to investigate fraud, abuse, security threats, or violations of our rights or these Terms; and
- With your consent or at your direction.
We do not sell personal information for money. If our practices change in a way that requires additional notice or consent under applicable law, we will provide it.
8.SERVICE PROVIDERS AND INFORMATION OUTSIDE YOUR PROVINCE
Some of our service providers may process or store information outside Ontario, outside Quebec, or outside Canada. As a result, personal information may be subject to the laws of the jurisdiction where it is processed and may be accessible to courts, law-enforcement, or governmental authorities in accordance with those laws. Where Quebec law applies, we will take the steps required by law before communicating personal information outside Quebec.
9.RETENTION
We retain personal information only for as long as reasonably necessary for the purposes for which it was collected, to meet legitimate operational needs, to comply with legal obligations, to resolve disputes, and to enforce agreements. When information is no longer required, we will destroy it or otherwise handle it in accordance with applicable law and our retention practices.
10.SECURITY
We use reasonable administrative, technical, and organizational safeguards appropriate to the nature and sensitivity of the information in our control. No website, transmission method, or storage system can be guaranteed to be completely secure. You use the Services with that understanding.
11.MINORS
The Services are intended for a general audience. Minors should use the Services and submit personal information only in accordance with applicable law and with parental or guardian involvement where required. Contest-specific age and guardian requirements also apply. In Quebec, personal information concerning a minor under 14 generally may not be collected from the minor without the consent of a parent or tutor, except where the collection is clearly for the minor’s benefit or otherwise permitted by law.
12.YOUR PRIVACY RIGHTS
Subject to applicable law and any lawful exceptions, you may request access to personal information we hold about you, request correction of inaccurate or incomplete information, ask questions about our privacy practices, or withdraw consent where consent is the basis for processing.
If Quebec privacy law applies to you, you may also have additional rights in applicable circumstances, including the right to request cessation of dissemination or de-indexing of certain personal information, and the right to request eligible computerized personal information collected from you in a structured, commonly used technological format. Where a decision is based exclusively on automated processing of personal information, any rights and disclosures required by Quebec law will apply.

14.CHANGES TO THIS PRIVACY POLICY
We may update this Privacy Policy from time to time. If we make material changes, we will provide notice in a manner appropriate to the change and as required by applicable law.
Part II — Terms of Use
1.ACCEPTANCE OF TERMS
By accessing or using the Services, you agree to these Terms of Use (“Terms”). If you do not agree, do not use the Services. If you use the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
2.ABOUT HABSINFINITY
HabsInfinity is an independent fan-media platform focused on the Montreal Canadiens. We are not the Montreal Canadiens, the National Hockey League, or an official representative of either organization. Team names, league names, logos, player images, trademarks, and other third-party materials remain the property of their respective owners.
3.INFORMATIONAL AND EDITORIAL CONTENT
Our content may include news, commentary, opinion, statistics, rumours, projections, historical information, graphics, rankings, polls, and community discussion. We try to provide useful and timely content, but we do not guarantee that all information is complete, current, error-free, or suitable for any particular purpose. Opinions are opinions and may change. Rumours and third-party reports should not be treated as confirmed facts unless we clearly state otherwise.
Nothing on the Services constitutes legal, financial, medical, investment, or gambling advice. Any decisions you make based on sports information, odds, predictions, or commentary are your own responsibility.
4.INTELLECTUAL PROPERTY
Except for third-party materials, the HabsInfinity name, branding, original graphics, layouts, written content, compilations, page design, and other original materials made available through the Services are owned by or licensed to HabsInfinity and are protected by applicable intellectual-property laws.
You may view and share links to our public content for personal, non-commercial purposes. Unless we give you written permission, you may not copy, reproduce, republish, distribute, sell, license, modify, remove branding from, create derivative commercial works from, scrape, systematically download, or commercially exploit HabsInfinity content. You may not use our original content or datasets to train, fine-tune, benchmark, or develop artificial-intelligence or machine-learning systems without our prior written permission, except to the extent such restriction is prohibited by applicable law.
5.USER SUBMISSIONS AND COMMUNITY CONTENT
If you submit content to HabsInfinity — including comments, messages, photos, videos, ideas, contest entries, or other materials — you represent that you have the right to submit it and that doing so does not violate the rights of any person or law.
Unless specific contest or submission rules say otherwise, you grant HabsInfinity a non-exclusive, worldwide, royalty-free, transferable and sublicensable licence to host, reproduce, edit, adapt, publish, display, distribute, and promote the submitted content in connection with HabsInfinity and its social-media, editorial, promotional, and archival activities. To the extent permitted by law, you waive any moral rights in the submitted content in favour of HabsInfinity and those authorized by HabsInfinity. You retain ownership of your original content.
We are not required to publish, keep, or return submissions, and we may remove or refuse content at our discretion, subject to applicable law.
6.PROHIBITED USE
You may not use the Services to:
- Violate any applicable law or the rights of another person;
- Harass, threaten, impersonate, defame, or unlawfully target another person;
- Upload malicious code, interfere with security, overload the Services, or attempt unauthorized access;
- Scrape, crawl, harvest, or systematically extract content or data except through means we expressly authorize;
- Misrepresent HabsInfinity content as official Montreal Canadiens or NHL content;
- Use our branding or original materials in a way that suggests sponsorship, endorsement, partnership, or affiliation without written permission; or
- Use the Services for fraudulent, deceptive, or abusive activity.
7.CONTESTS AND PROMOTIONS
Contests, giveaways, or promotions are subject to the HabsInfinity Contest & Giveaway Rules and may also be subject to giveaway-specific eligibility requirements, deadlines, prize terms, verification requirements, release terms, and other conditions. Entrants may be required to follow @habsinfinity, provide the HabsInfinity-generated Session ID or entry ID associated with an entry, complete winner verification, and, for chance-based contests where required, correctly answer a mathematical skill-testing question. Unless a specific giveaway expressly states otherwise, HabsInfinity may not receive or know the identity of the winner when the contest ends. The winning participant is responsible for contacting HabsInfinity and submitting a valid claim within 24 hours after the stated contest closing date and time. HabsInfinity has no obligation to locate, identify, or notify the winner. If no valid winning claim is received within that 24-hour period, the win may be forfeited and the prize may be made available to the next eligible participant who submits a valid winning claim under the applicable contest mechanics. HabsInfinity may disqualify or refuse a prize where it reasonably determines that an entrant used cheating, bots, automation, duplicate or manipulated sessions or accounts, tampering, exploits, false information, fraud, or another prohibited method. If giveaway-specific official rules conflict with these Terms, those official rules govern for that promotion. Void where prohibited. Any cancellation, suspension, modification, alternate-winner selection, forfeiture, or disqualification will be handled as permitted by the applicable rules and law.
8.THIRD-PARTY LINKS, SOCIAL MEDIA, AND SERVICES
The Services may link to or embed third-party websites, social-media platforms, videos, advertisements, stores, statistics providers, or other services. HabsInfinity does not control those third parties and is not responsible for their content, availability, security, privacy practices, products, or services. Your use of a third-party service is governed by that third party’s terms and policies.
9.AVAILABILITY AND CHANGES
We may change, suspend, restrict, or discontinue any part of the Services at any time, with or without notice, subject to applicable law. We do not guarantee uninterrupted or error-free availability.
10.DISCLAIMER OF WARRANTIES
To the maximum extent permitted by law, the Services and all content are provided on an “as is” and “as available” basis, without representations, warranties, or conditions of any kind, whether express, implied, statutory, or otherwise, including implied warranties or conditions of merchantability, fitness for a particular purpose, accuracy, title, non-infringement, or uninterrupted availability. Nothing in these Terms excludes any warranty, condition, or right that cannot lawfully be excluded.
11.LIMITATION OF LIABILITY
To the maximum extent permitted by law, HabsInfinity and its operators, owners, contributors, contractors, affiliates, representatives, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, or opportunities, arising from or relating to your use of or inability to use the Services, reliance on content, third-party services, or unauthorized access to information.
To the maximum extent permitted by law, the total aggregate liability of HabsInfinity for all claims arising out of or relating to the Services or these Terms will not exceed the greater of (a) CAD $100 and (b) the amount, if any, you paid directly to HabsInfinity for the relevant Services during the 12 months before the event giving rise to the claim. These limitations do not apply to liability that cannot legally be excluded or limited, including where mandatory consumer-protection law provides otherwise.
12.INDEMNITY
To the extent permitted by law, you agree to defend, indemnify, and hold harmless HabsInfinity and its operators, owners, contributors, contractors, affiliates, and representatives from claims, damages, liabilities, losses, and reasonable costs arising from your unlawful use of the Services, your violation of these Terms, or your infringement of another person’s rights. This section does not apply to the extent prohibited by applicable consumer-protection law.
13.TERMINATION OR RESTRICTION OF ACCESS
We may suspend, restrict, or terminate access to interactive features or the Services where we reasonably believe a user has violated these Terms, created security or legal risk, or abused the Services. Any provisions that by their nature should survive termination will survive, including intellectual-property, disclaimer, limitation-of-liability, and dispute provisions.
14.GOVERNING LAW
Except where mandatory law requires otherwise, these Terms and any dispute arising from them or the Services are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario, without regard to conflict-of-law principles.
If you are a consumer resident in Quebec, nothing in these Terms limits any rights or remedies you have under mandatory Quebec law, and any governing-law, forum, warranty, liability, indemnity, or similar provision in these Terms applies only to the extent permitted by those laws.
15.DISPUTES AND JURISDICTION
Before starting formal proceedings, we encourage you to contact us at habsinfinity@gmail.com so we can try to resolve the issue. Except where applicable law gives you the right to bring a proceeding elsewhere, the courts located in Ontario will have jurisdiction over disputes relating to these Terms or the Services. Quebec consumers retain any forum or procedural rights that cannot lawfully be waived.
16.CHANGES TO THESE TERMS
We may update these Terms from time to time. The updated version will be posted on this page. Where required by law, we will provide additional notice. Your continued use of the Services after an update takes effect constitutes acceptance of the revised Terms to the extent permitted by law.
17.SEVERABILITY AND NO WAIVER
If any provision of these Terms is found to be invalid, illegal, or unenforceable, that provision will be enforced to the maximum extent permitted and the remaining provisions will continue in effect. Our failure to enforce a provision is not a waiver of our right to enforce it later.
18.ENTIRE AGREEMENT
These Terms, together with this Privacy Policy and any additional terms or official rules that expressly apply to a feature, contest, promotion, purchase, or service, form the agreement between you and HabsInfinity regarding your use of the Services.
